Terms & Conditions

This agreement governs your access to and use of The Vivos Institute’s educational materials and participation in SMS communications. By enrolling in educational programs, accessing training content, or opting in to receive SMS messages, you acknowledge and agree to comply with the terms outlined below. These terms are designed to protect educational integrity, patient privacy, intellectual property, and communication transparency.


1. Purpose and Scope of Agreement

This agreement outlines the terms and conditions governing access to and use of The Vivos Institute’s educational materials, including but not limited to case reviews, creative assets, patient images, and related instructional content. It also includes terms governing SMS communications where applicable.


2. Purpose of Use (Educational Materials)

The educational materials provided by The Vivos Institute are intended strictly for educational and professional training purposes within the provider’s licensed scope of practice. These materials may not be used for marketing, advertising, promotional, or other commercial purposes unless explicitly authorized in writing by The Vivos Institute.


3. Restrictions on Use of Educational Materials

By accessing Vivos educational content, you agree to the following restrictions:

  • No Recordings: You may not record, capture, reproduce, or distribute any portion of case reviews or educational materials by any means, including audio recordings, video recordings, screenshots, or screen captures.

  • Patient Image Restrictions: Patient images may not be used for marketing or any other non-educational purpose without the explicit written consent of the patient or their legal guardian.

  • Ownership and Rights: All materials remain the sole property of The Vivos Institute. You are granted limited, non-transferable access solely for educational use. Any other use requires prior written authorization.

  • Modifications: You may replace Vivos-provided patient images only with images from your own practice. Any other modification, adaptation, or reuse requires prior written approval from The Vivos Institute.


4. Educational Use Acknowledgment

You acknowledge that all case reviews, instructional materials, and educational content are provided exclusively for training and professional development purposes. You agree not to share, distribute, publish, or otherwise use these materials beyond their intended educational scope.


5. Reviews and Testimonials

By submitting a testimonial or review, you acknowledge and agree that it may be published by The Vivos Institute on its website, social media platforms, or other promotional channels. Publication may include your name, photo, professional title, and practice name and/or location.

To request limited publication (for example, first name and last initial with professional role only), you may email ce@thevivosinstitute.com after submitting your review.


6. SMS Description of Service and Communications

Carrier Liability for SMS or Phone:

Please note that carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for any messages sent to you from us and to us from you. Carriers are not liable for content of messages.

SMS Description of Service

By opting in to receive SMS text messages from The Vivos Institute, you agree to receive recurring automated and personalized messages at the phone number provided at the time of opt-in.

Our SMS program includes:

· Follow-up and general business communications and/or

· Marketing communications from The Vivos Institute®, including

· Educational content

· Course information

· Event updates

· Promotional materials.

· Scheduling appointments for Clinical Studies.

· Clinical communication: Direct updates from our staff regarding information regarding courses are you enrolled in (e.g., weather closures).

· Marketing & Promotions: Exclusive offers for courses at The Vivos Institute (e.g., Buteyko Breathing, Breathing Wellness Summit, Frenectomy Crash Course, etc)

Important Details:

· Consent is not a condition of purchase: You are not required to opt-in to marketing texts to receive healthcare services from us.

· Message Frequency: The number of messages you receive will vary based on your appointment schedule and your chosen subscription preferences.

· Costs: Message and data rates may apply depending on your mobile data plan.

· Liability: Mobile carriers are not liable for delayed or undelivered messages.


7. SMS Opt-Out & Stop Policy

We want to ensure that our communications remain helpful and never intrusive. You have full control over your SMS preferences at all times.

· How to Opt-Out: You may cancel the SMS service at any time. Simply reply “STOP” to any text message you receive from us.

· Confirmation: After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

· Help & Support: If you are experiencing issues with the messaging program, you can reply with the keyword “HELP” for more assistance, or you can get help directly at ce@thevivosinstitute.com or 720-399-9322.

· Carrier Liability: Please note that carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for any messages sent to you from us and to us from you.


8. Compliance and Enforcement

Failure to comply with the terms of this agreement may result in immediate revocation of access to educational materials and may subject you to additional administrative or legal action as deemed appropriate by The Vivos Institute.


9. Agreement to Terms

By accessing Vivos educational materials and/or opting in to SMS communications, you confirm that you have read, understood, and agree to abide by the terms and conditions outlined in this agreement.

By completing and submitting this order form, you acknowledge and agree to the following:

  1. Collection of Personal Data: You understand that in order to process your order effectively, we require certain personal information including but not limited to your name, contact details, shipping address, and payment information.
  2. Purpose of Data Collection: The personal data collected through this order form will solely be used for the purpose of processing and fulfilling your order, as well as communicating with you regarding your order status and related matters.

  4. Third-Party Disclosure: We do not sell, trade, or otherwise transfer your personal information to outside parties unless necessary for order fulfillment (e.g., shipping companies) or as required by law.
  5. Data Retention: Your personal data will be retained only for as long as necessary to fulfill the purposes outlined in this disclaimer or as required by applicable laws and regulations.
  6. Consent and Authorization: By submitting this order form, you consent to the collection, processing, and storage of your personal data as described herein.
  7. Data Subject Rights: You have the right to request access to, correction of, or deletion of your personal information held by us. For any inquiries or requests regarding your personal data, please contact us using the provided contact information.
  8. Updates to Disclaimer: We reserve the right to update or modify this disclaimer at any time without prior notice. Any changes will be effective immediately upon posting on our website or notifying you directly.
  9. Acceptance of Terms: By proceeding with the order, you signify your acceptance of this disclaimer and consent to the processing of your personal data in accordance with its terms.

Event Cancellation Policy for
The Vivos Institute®

Thank you for your interest in our programs at The Vivos Institute®. We understand that sometimes circumstances may arise that require you to cancel your participation. Please review our cancellation policy carefully.

Standard Cancellation Policy:

  • 100% Refund: Cancellations received within 61 days or more before the start date of the program will receive a full refund minus a 7% administrative fee.
  • 85% Refund: Cancellations received within 31 to 60 days before the start date of the program will be eligible for an 85% refund of the program fee minus a 7% administrative fee..
  • No Refund: Cancellations received within 30 days of the program start date will not be eligible for a refund.

Please Note: All cancellations are subject to an additional 7% administrative fee, regardless of how far in advance the cancellation is received.

Cancellation Process: All cancellation requests must be submitted in writing via email to ce@thevivosinstitute.com. Please include your full name, contact information, program name, and the reason for cancellation in your email.

Special Events: Please note that this cancellation policy is subject to change for special events. Specific cancellation policies for special events will be communicated at the time of registration and will supersede the standard cancellation policy outlined above.

Refund Processing: Refunds, if applicable, will be processed within 30 days of receiving the cancellation request. Refunds will be issued to the original method of payment used during registration.
